Passenger Terms & Conditions
The rules governing passenger accounts, ride requests, bookings and use of LUXi services.
1. Agreement to These Terms
Effective Date: September 5, 2026. These Passenger Terms & Conditions (the “Passenger Terms”) govern your access to and use of the LUXi passenger application, website, booking tools, communications, and transportation-related services (collectively, the “LUXi Services”). By creating or using an account, checking an acceptance box, requesting a verification code after the applicable disclosure, requesting or booking a ride, or otherwise using the LUXi Services, you agree to these Passenger Terms and acknowledge the Passenger Privacy Policy and applicable Text Messaging Policy. If you do not agree, do not use the LUXi Services.
2. Nature of the LUXi Platform
LUXi provides a digital platform through which riders may request or arrange prearranged transportation with eligible drivers. Except to the extent applicable law or a specific written agreement provides otherwise, drivers using the platform provide transportation as independent contractors and are not employees of LUXi. Nothing in these Passenger Terms eliminates or limits any responsibility that applicable law expressly imposes on LUXi.
3. Eligibility and Accounts
You must be legally capable of entering a binding agreement and provide accurate, current information. You are responsible for activity under your account and for safeguarding access to your device and verification credentials. You may request a ride for another person only if you are authorized to do so and provide accurate information needed to complete the trip.
4. Ride Requests; No Guarantee of Availability
A request, quote, reservation, scheduled pickup, confirmation, or other communication does not guarantee that a particular driver or vehicle will be available or that transportation will occur at an exact time. A ride becomes subject to driver acceptance and continued availability. LUXi may decline, cancel, reassign, or modify a request when reasonably necessary because of driver availability, safety concerns, inaccurate information, road or weather conditions, vehicle issues, emergencies, legal requirements, suspected fraud, events outside reasonable control, or other operational circumstances.
Time-sensitive travel: pickup, travel, and arrival times are estimates unless LUXi expressly agrees otherwise in a separate written instrument. You are responsible for allowing adequate time for traffic, security screening, flight check-in, appointments, connections, road closures, weather, and other foreseeable delays.
5. Airports, Flights and Appointments
LUXi does not control airlines, airports, security lines, traffic systems, road conditions, event operations, or appointment providers. To the maximum extent permitted by law, LUXi is not responsible for a missed flight, cruise, train, appointment, meeting, reservation, connection, event, or other consequential loss resulting from delay, cancellation, inaccurate rider information, or circumstances outside LUXi’s reasonable control. This provision does not waive liability that cannot lawfully be waived.
6. Fares, Quotes, Charges and Payment
Before a ride begins, applicable fare information or the method used to calculate the fare will be made available as required by law. Quotes or estimates may change when trip details change, including pickup or destination, stops, waiting time, route, service type, tolls, parking, airport charges, taxes, surcharges, or other disclosed factors. You authorize LUXi and its payment service providers to charge the payment method associated with your booking for authorized fares, fees, adjustments, cancellation or no-show charges, and other amounts disclosed to you or permitted by these Passenger Terms. Payment-card information may be processed by payment service providers rather than stored directly by LUXi.
7. Cancellations, No-Shows and Changes
Cancellation, waiting-time, no-show, modification, and refund rules presented in the booking experience or otherwise disclosed for a ride are incorporated into these Passenger Terms. If you change a trip after booking, availability and pricing may change. A driver may leave after an applicable waiting period or when safety or operational circumstances reasonably require it.
8. Rider Conduct and Safety
You and anyone traveling under your booking must act lawfully and respectfully; follow reasonable safety instructions; wear seat belts when required; avoid threatening, abusive, discriminatory, dangerous, fraudulent, or disruptive conduct; and refrain from damaging or excessively soiling a vehicle. Smoking, unlawful drugs, weapons prohibited by law, open containers where prohibited, and conduct that creates an unsafe driving environment are prohibited. LUXi may refuse or discontinue service when reasonably necessary for safety, legal compliance, or serious misconduct.
9. Minors, Service Animals and Accessibility
Riders are responsible for complying with laws governing child passengers and required child-restraint systems. Unless a service specifically states otherwise, LUXi does not provide childcare or supervision. LUXi and drivers will comply with applicable nondiscrimination and service-animal requirements. LUXi does not impose an additional charge solely because a rider has a physical disability. Contact support@goluxi.com if you need assistance regarding accessibility.
10. Luggage, Personal Property and Lost Items
You are responsible for confirming that your belongings are removed from the vehicle at the end of a trip. LUXi does not guarantee recovery or return of lost property. Reasonable efforts may be made to facilitate a return, and a disclosed return or delivery fee may apply. Do not place irreplaceable or unusually valuable property in a vehicle unless you can maintain custody of it.
11. Communications and SMS
LUXi may send service-related communications needed to administer your account, authentication, booking, safety, support, or trip. SMS use is governed by the Text Messaging Policy. Promotional text messages, if offered, require the level of consent required by applicable law and are not a condition of purchasing transportation services.
12. Privacy and Location Information
Your use of the LUXi Services is subject to the Passenger Privacy Policy. Transportation functionality may require pickup, destination, device, or location information. You control device permissions through your operating-system settings, although disabling required permissions may limit functionality.
13. Third-Party Services
The LUXi Services may depend on third-party payment processors, mapping, communications, cloud, analytics, identity, security, app-store, or other service providers. LUXi is not responsible for a third party’s independent services, outages, or conduct except to the extent responsibility cannot be excluded under applicable law.
14. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE LUXI SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” LUXI DOES NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION, CONTINUOUS DRIVER AVAILABILITY, A PARTICULAR VEHICLE, OR AN EXACT PICKUP OR ARRIVAL TIME. NOTHING IN THESE TERMS DISCLAIMS WARRANTIES OR RIGHTS THAT CANNOT LAWFULLY BE DISCLAIMED.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUXI AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST BUSINESS, OR LOSSES ASSOCIATED WITH A MISSED FLIGHT, APPOINTMENT, CONNECTION, OR EVENT, ARISING FROM OR RELATED TO THE LUXI SERVICES. ANY LIMITATION APPLIES ONLY TO THE EXTENT PERMITTED BY APPLICABLE LAW AND DOES NOT EXCLUDE LIABILITY THAT CANNOT LEGALLY BE LIMITED OR EXCLUDED.
16. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless LUXi and its affiliates, members, managers, officers, employees, and agents from third-party claims, losses, liabilities, damages, and reasonable costs arising from your unlawful conduct, material breach of these Passenger Terms, fraudulent use of the LUXi Services, or damage caused by you or persons traveling under your booking. This obligation does not require you to indemnify LUXi for LUXi’s own liability where prohibited by law.
17. Suspension and Termination
LUXi may restrict, suspend, or terminate access when reasonably necessary to protect users, investigate suspected fraud or misconduct, comply with law, enforce these Passenger Terms, or protect the platform. You may stop using the services at any time and may request account deletion as described on the Account & Data Deletion page.
18. Disputes; Governing Law
These Passenger Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules, except where federal law or another mandatory law applies. Before filing a non-emergency claim, you and LUXi agree to make a good-faith effort for at least 30 days to resolve the dispute informally after written notice to support@goluxi.com. Nothing here prevents either party from seeking relief in small-claims court when eligible or from seeking emergency injunctive relief. Any forum-selection, arbitration, jury-waiver, or class-waiver provision should be separately reviewed by qualified Florida counsel before implementation; these Passenger Terms do not create such a waiver merely by implication.
19. Changes; Severability; Entire Agreement
LUXi may update these Passenger Terms prospectively. Material changes will be communicated as required by law, and continued use after the effective date constitutes acceptance where legally permitted. If any provision is held unenforceable, the remaining provisions remain effective to the maximum extent permitted. These Passenger Terms, together with policies expressly incorporated by reference and any trip-specific terms presented to you, constitute the applicable agreement concerning your use of the passenger-facing LUXi Services.
