Driver Terms & Conditions
The rules governing driver eligibility, platform access, transportation activity, safety and related obligations.
1. Agreement and Effective Date
Effective Date: September 5, 2026. These Driver Terms & Conditions (the “Driver Terms”) govern your access to and use of the LUXi driver application and platform. By registering, checking an acceptance box, requesting a verification code after the applicable disclosure, accessing driver features, or accepting ride opportunities, you agree to these Driver Terms and acknowledge the Driver Privacy Policy and Text Messaging Policy.
2. Independent Contractor Relationship
You and LUXi intend and agree that, to the extent permitted by applicable law, you perform transportation services as an independent contractor and not as an employee, agent, partner, joint venturer, or representative of LUXi. You control whether and when to log on, whether to accept available ride opportunities, and—subject to law, safety requirements, accepted trip obligations, and these Driver Terms—the manner and means of providing transportation. LUXi does not require exclusive use of the LUXi platform and does not prohibit lawful work or business outside LUXi.
This provision is intended to reflect the actual relationship and applicable law; a contractual label does not override mandatory law.
3. Driver Eligibility and Continuing Duties
You must at all times satisfy applicable legal and platform eligibility requirements, including maintaining a valid driver license, lawful vehicle registration, required insurance, and any permits, inspections, credentials, background-check eligibility, driving-history standards, or other documentation required by law or LUXi. You must promptly notify LUXi of any suspension, expiration, cancellation, material restriction, disqualifying event, accident, criminal charge or conviction where legally relevant, or other change that may affect eligibility.
4. Background and Driving-History Screening
You authorize LUXi and authorized screening providers, subject to applicable law and any required standalone disclosures/authorizations, to obtain and review background, identity, motor-vehicle, and driving-history information for eligibility, safety, and compliance purposes. Where Florida transportation-network-company requirements apply, screening and periodic rescreening will be conducted as required by law. Separate disclosures or authorizations required by the Fair Credit Reporting Act or other law are not replaced by these Driver Terms.
5. Vehicle Requirements
You are responsible for ensuring that every vehicle you use is legally registered, safe, roadworthy, clean, properly maintained, and eligible for the service offered. You may use only a vehicle authorized for your driver account. You are responsible for inspections, maintenance, repairs, fuel or charging, tolls, cleaning, depreciation, financing, taxes, and other operating expenses unless LUXi expressly agrees otherwise in writing.
6. Insurance
You must maintain all automobile insurance required by applicable law and by LUXi for every period in which you are logged on, available for ride requests, traveling to a rider where applicable, or engaged in a prearranged ride. Personal automobile policies may exclude transportation-for-compensation or platform activity. You are responsible for understanding your policy and maintaining appropriate coverage. Where applicable law requires insurance to be maintained by LUXi, the driver, the vehicle owner, or a combination of them, nothing in these Driver Terms reduces those statutory requirements.
7. Ride Opportunities and Performance
Ride opportunities are not guaranteed. Unless a specific program states otherwise, you are not promised any minimum number of requests, hours, earnings, fares, or geographic demand. Once you accept a trip, you must perform it professionally and safely unless cancellation is reasonably necessary. You may not solicit or accept unlawful street hails or off-platform rides in violation of applicable law.
8. Fares, Driver Payments, Fees and Taxes
Applicable fare, driver-payment, commission, platform-fee, incentive, adjustment, chargeback, cancellation, or other compensation terms may be presented in the driver application or separate written program terms. You are responsible for reviewing those terms before accepting applicable activity. As an independent contractor, you are responsible for your own federal, state, and local tax obligations, records, deductions, licenses, and business expenses, except to the extent applicable law requires otherwise.
9. Safety; Zero Tolerance for Drugs and Alcohol
LUXi maintains zero tolerance for drug or alcohol use by a driver while providing a prearranged ride or while logged on and available to provide rides. A driver must not drive while impaired by alcohol, unlawful drugs, medication, fatigue, illness, distraction, or any condition that makes driving unsafe. A complaint reasonably alleging prohibited impairment may result in immediate suspension of ride-access privileges while the matter is investigated, as required or permitted by applicable law.
10. Nondiscrimination, Accessibility and Service Animals
You must comply with LUXi’s nondiscrimination policy and all applicable federal, state, and local nondiscrimination and accessibility laws. You may not unlawfully discriminate against riders or potential riders. You must comply with applicable service-animal requirements and may not impose unauthorized disability-related charges.
11. Professional Conduct and Prohibited Activity
You must treat riders professionally; obey traffic and safety laws; avoid harassment, threats, discrimination, violence, fraud, reckless driving, unlawful weapons, and unsafe phone use; protect rider information; and never use rider information for an unauthorized purpose. You may not manipulate trips, fares, location, identity, documents, ratings, accounts, or payment systems; permit an unauthorized person to use your driver account; or misrepresent the vehicle or driver providing a ride.
12. Accidents, Incidents and Cooperation
You must promptly report accidents, injuries, safety incidents, law-enforcement contacts relating to a trip, and material vehicle damage through designated LUXi support channels and cooperate reasonably with safety, insurance, claims, and legal investigations. You must provide information required by applicable law regarding whether you were logged on or engaged in a prearranged ride at the time of an accident.
13. Location, Device and Operational Data
The driver application may require precise location and related device data, including while the app operates in the background, to offer trips, match riders and drivers, support navigation, calculate trip activity, facilitate safety and support, prevent fraud, and maintain legally required records. Details are provided in the Driver Privacy Policy.
14. No Employment Benefits or Authority
Except where mandatory law provides otherwise, you are not entitled by virtue of these Driver Terms to wages, overtime, unemployment benefits, workers’ compensation benefits, paid leave, retirement benefits, or other employee benefits from LUXi. You have no authority to bind LUXi to a contract, incur obligations on LUXi’s behalf, or make representations that you are an employee or authorized agent of LUXi.
15. Suspension, Deactivation and Investigation
LUXi may temporarily suspend or deactivate access when reasonably necessary for safety, suspected fraud, eligibility issues, expired documentation, legal or insurance requirements, serious complaints, material breach, or investigation. Where applicable law requires a particular process, LUXi will follow that process. Provisions that by their nature should survive termination—including payment obligations, confidentiality/privacy duties, indemnification, and dispute provisions—survive.
16. Confidentiality and Rider Information
Rider names, phone numbers, pickup and destination details, trip information, and other nonpublic information are provided only for legitimate transportation and support purposes. You may not sell, publish, retain unnecessarily, contact riders for unrelated purposes, or otherwise misuse personal information obtained through LUXi.
17. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless LUXi and its affiliates, members, managers, officers, employees, and agents from third-party claims, liabilities, losses, damages, penalties, and reasonable costs arising from your unlawful conduct, material breach of these Driver Terms, operation or ownership of your vehicle, failure to maintain required credentials or insurance, tax obligations, or negligent or intentional misconduct. This provision does not require indemnification for LUXi’s own liability where prohibited by law.
18. Disclaimers and Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DRIVER PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.” LUXi DOES NOT GUARANTEE PLATFORM UPTIME, RIDE VOLUME, DRIVER EARNINGS, PARTICULAR FARES, OR CONTINUOUS ACCESS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUXi WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM PLATFORM USE. NOTHING HERE LIMITS LIABILITY THAT CANNOT LEGALLY BE LIMITED.
19. Disputes and Governing Law
These Driver Terms are governed by Florida law, except where federal law or another mandatory law applies. Before filing a non-emergency claim, you and LUXi agree to attempt in good faith to resolve the matter for at least 30 days after written notice to support@goluxi.com. Nothing prevents an eligible small-claims action or emergency injunctive relief. Any arbitration, jury-trial waiver, or class-action waiver should be implemented only after separate review by qualified Florida counsel; these Driver Terms do not create such a waiver by implication.
